Fox is really hot dogging about this Nathan's site story as if any of it were news at all. And as usual, Brian Fox doesn't even know the basic facts about the reasons for making the deal to build a school at that location.
The developer bought this site from Nathan's Famous before either Brannan or Gounardes were ever elected. Much later on, but still about three years ago the Brooklyn Eagle comletely reported on the resale of the property at 86th Street between Battery Avenue and 7th Avenue to the NYC SCA to build out as a school for Bd. of Ed.
In the 2019 Brooklyn Eagle article by Meaghan McGoldrick, the details of the deal, including the doubling of the value placed on the site were fully explained, and it was even compared to the higher prices paid by the Bd. of Ed. & SCA for similar sites in Manhattan, Queens, Staten Island, and elsewhere in Brooklyn.
Justin Brannan was quoted in the article, and he openly and forcefully stated the high price that was being paid by the NYC SCA for the site was justified. Brannan said the area had a desparate need for more school space, and failing to make the deal was not an option, because of the location of the site, and its increased commercial value to the developer as a long term rental to a national grocery chain.
Brian Fox should not be driving a car in his health. He is morbidly obese and visibly unhealthy. A man in his condition should not be operating a motor vehicle especially given the history he has with DWI arrests.

Bistreich settled for peanuts compared to what he and his mum were after; and that settlement was accepted after the courts dismissed the only individual claims that were asserted against the individual defenant City Councilman Vincent Gentile, and no individual claoms were ever asserted against Justin Brannan. And in 2021, neither Fox nor Brannan asked for a recount or qualified for a recount. There was one and only one official count and Brannan won.

First, why keep repeating that Mikey Bistreich got $850,000 when he didn't get nearly that amount.
Second, no court at any level ever ruled that Bistreich had proved any of the underlying allegations in his case --- in fact, several of his claims and allegations were summarily dismissed, for example, those claiming that Councilman Gentile was personally involved. Also, Justin Brannan was never a named as party in Bistreich's case, and there were never any allegations that Brannan did anything wrong.
Law firms like Schwartz Perry & Heller, LLP do not work for nothing, and typically a case like Bistreich's also has a lot of additional fees and expenses deducted from any payout, due to private investigations, necessary appeals, expert opinions to establish damages, and the like --- all of that would come off the top of what was reported to have been $850,000.
In addition, that "$850,000" was only an amount provided to the press; given Bistreich's personal and social limitations, it is likely that what was tendered to Bistreich was a structured settlement that would provide him with an income, rather than a lump sum.
$850,000 was the amount Bistreich got from the taxpayers. How much did brannen or hois backers pay bistreich?
Bistreich didn't get $850,000 from anyhbody least of all Brannan. This wasn't about Brannan until some GOP or Conservative types started to con Bistreich and his mom.
