In January 2014, all that was left in John O'Mara's office was the top of a transfile box --- were critical papers about the persecution of John Kennedy O'Hara through three trials in that transfile --- were there transcripts and/or recordings of converations with the now-codefendats in the O'Hara federal case for damages ??? Well, that's what civil discovery is all about --- is it not !!! |
Former ADA John O'Mara was not only the prosecutor in court for all three of the unprecedented triple trial persecution of John Kennedy O'Hara for an ersatz concatenation of factual allegations to support a multiple count indictment for election fraud and illegal voting --- ADA O'Mara was the virtual gatekeeper as to what evidnce was presented to the grand jury in order to obtain the indictment against John Kennedy O'Hara, and what exculpatory evidence was not allowed to go to the grand jury concerning the charges being brought against JK O'Hara; as well as much of what did and did not get to the juries in open court during the three trials of JK O'Hara --- much of the exculpatory evidence that ADA O'Mara knew existed yet strenuously fought to keep out of court.
However, the real reason the JK O;Hara team believes that ADA O'Mara might be the weakest link, is that while employed as a City/State employee, he consulted very closely with certain named individual co-defendants to introduce various spurious items of evidence to establish that John Kennedy O'Hara was a politician with a long history of proven past election frauds, when in fact, there was no such history of proven election frauds.
Moreover, ADA O'Mara will be a key witness to the fact that certain individual co-defendants, who were not part of the DA's office or investigative staff were allowed to be the key investigators and architects of the Brooklyn DA's case against John Kennedy O'Hara --- and that virtually everything presented to the grand jury was provided by the specific non-prosecutor co-defendants in JK O'Hara's civil case for damages, two of whom were the most active direct politrical opponents against Mr. J.K. O'Hara during several election cycles during the 1980s and 1990s.
Here's the rub for many of the co-defendants in the John Kennedy O'Hara case >>> one of the defendants, Defendant John [Jack] Carroll, has already blinked over a speck in his eye involving demands for non-party depositions of family members involving a false E-mail from the deceased former DA Hynes --- to be clear, that was a swag E-mail from the deceased former DA after he had died..... And how was it that Jack Carroll blinked? His lawyers and insurance company immediately tendered the entire $500,000 legal malpractice coverage available to pay the O'Hara claim after O'Hara's attorneys noticed the non-party witnesses for depositions.
Imagine how hard defendant Jack Carroll will blink if and when a co-defendant like ADA John O'Mara throws him under the bus. You see, in an affidavit filed in federal court, Jack Carroll has sworn that he "[inter alia]... did not interact with any of the named Defendants, including former District Attorney Charles J, Hynes, former District Attorney [sic] John O'Mara, former Assisatant District Attorney Angelo M. Morelli, former Assistant District Attorney Dino Amoruso, former District Attorney Investigator Allen Presser.... Other than providing information about the circumstances of [an alleged attack with a claw hammer upon Carroll in 1996, Jack Carroll swore that] I had no other discussions with anyone at the Kings County District Attorney's Office about indicting, prosecuting, or convicting Plaintiff [O'Hara for election] residency fraud...."
That would appear to be completely at odds with what is contained in an Official Report of the Conviction Review Unit of the Kings County District Attorney on the case that had been brought and prosecuted through three trials and finally a conviction against John O'Hara, all of which was vacated because of the Conviction Review Unit Report.
In addition to a conclusory statement, backed up by detailed footnote references, that all of the evidence provided to the grand jury by ADA O'Mara in order to obtain the indictment of John Kennedy O'Hara had come from Defendant James Brennan and Defendant John Carroll --- the report also specifically stated in small part about Defendant John [Jack] Carroll, that >>> ".... In any event a full-fledged criminal investigation was undertaken. [Jack] Carroll who stayed in touch with the KCDA's Chief of Investigations Morelli, and investigating prosecutor, O'Mara, turned over his private investigators findings from 1994, and provided current information about O'Hara's addresses.... "
The proof of that also would be included in the recordings and transcripts of interviews, referred to in the footnotes as as having been reviewed by the Kings County DA's Office Conviction Review Unit, and which recordings and transcrripts were once under the purview and control of Defendant ADA John O'Mara. Since those interviews had been with several of the co-defendants in the John Kennedy O'Hara federal civil lawsuit for damages for the false and unlawful indictment. conviction, and sentencing for election residency fraud and multiple acts of illegal voting, the Defendant Kings County District Attorney's Office has given Plaintiff John Kennedy O'Hara notice that he would be provided with access to such recorded and/or transcribed evidence.
Surely, four jacks are hard to beat, but there will be a nifty turn, and then who knows, O'Hara's hand might be stronger than four jacks if the right river runs through it. The way things look right now, the defendants whether they're called "Jack" or something else should maybe throw in their cards rather than building up the pot, paying to get a look at what else John Kennedy O'Hara might have in the hole or up his sleeve.
