It looks like the GOP is losing in the early going in the case to throw out the new district lines around New York State --- at least for the 2022 elections


A NY State Supreme Court judge says that New York's recently-passed maps for most political offices in districts in NYS most likely will survive for at least one year rather than throw the 2022 election calendar into turmoil.

According to the most authoritative daily newspaper in New York State for statewide matters, The Albany Times-Union  >>>  After a court hearing last Thursday, Steuben County Supreme Court Justice Patrick McAllister said that  "....  It is 'highly unlikely' the maps would be invalidated for use in 2022.... It would be a 'more prudent course' to let the maps be used this year...." 


For many experts on these matters, the immediate question as to whether the redistricting maps recently passed by the NYS Legislature and signed into law by the Governor would be used for this year's midterm elections appears to be nearly settled, based on the position stated by the trial court judge late last week.  The case remains with Justice McAllister, who is requiring that limited discovery to be completed, and an evidentiary hearing with expert testimony to be held on March 14th.

Most likely, however, the case would proceed beyond the lower court, where a final decision by the first appellate court needs to be made by April 4, with that decision possibly being appealed immediately on an expedited basis to the NYS Court of Appeals, the state's highest and final authority.

Republicans challenging the maps believe that there still remains some hope for different district lines for 2022 than the ones that are now before the courts.

The NYS Court of Appeals may be the highest authority in this state but it wont be the final authority. There is a federal question which will be resolved by the highest authority. The US Supreme Court.

1012, the US Supreme Court doesn't want to get involved in any case whose main complaint is political gerrymandering. its most recent decicion that stated that principle is the 2019 case, RUCHO V. COMMON CAUSE
