Supreme Court upholds law from Mississippi that bans abortion after 15 weeks --- Court's decision also opened door to broader prohibitions on abortion procedures
In its own way, the U.S. Supreme Court is now part of the winds of change sweeping America
The U.S. Supreme Court, in a 6-3 ruling backed by its conservative majority, upheld a Republican-backed Mississippi law that bans abortion after 15 weeks of pregnancy. Beyond that, by a 5-4 vote the Court overturned Roe v.Wade completely [with conservative Chief Justice John Roberts concurring only in part, but writing separately to say he would have upheld the Mississippi law, without going so far as to erase the Roe v. Wade precedent altogether].
It's likely that reverberations of this ruling by the current Supreme Court will be felt far beyond the court's judicial sphere >>> potentially reshaping the environemnt for this November's congressional elections.
Togehter with yesterday's decision to overturn the NYS law on "concealed carry permits" for handguns, it also would seem to signal a new openness by the current crop of Supreme Court Justices to weigh-in and change long held precedent on other perceived constitutional rights.
Conversely, these decisions will also intensify the debate over the legitimacy of this somewhat Trump-appointed majority court. Once an unassailable cornerstone of the American democratic system, the present majority of Suprem Court Justices has been increasingly under scrutiny for its more aggressively conservative decisions on a range of issues.

UPDATE & BACKFILL: THE "FAILURE OF NICOLE MALLIOTAKIS TO APPLAUD THE SCOTUS DECISION ON A CONSTITUTIONALLY/ FEDERALLY DEFINED RIGHT TO AN ABORTION" EDITION
ReplyDeleteIT LOOKS LIKE NICOLE WOULD RATHER THAT ALL OF THIS DIDN'T HAPPEN --- SO FAR, SHE REMAINS EVASIVE ON THE ISSUE OF THE SUPREME COURT'S OVERTURNING OF ROE V. WADE --- SHE HAS STEADFASTLY AVOIDED EXPRESSING HER OPINION AS TO THE OVERALL ABORTION RIGHTS CONFERRED BY THE SUPREME COURT FIFTY YEARS AGO --- OR ANY FEDERALLY DEFINED RIGHT TO AN ABORTION
Congresswoman Nicole Malliotakis has only pointed out that the U.S. Supreme Court's ruling will not affect the availabity of abortions in New York, saying only >>> “Sadly New York’s radical late-term abortion law will be unaffected by this decision. Like an overwhelming majority of New Yorkers, I oppose New York’s law allowing abortions up until birth, non-doctors to perform them, and removal of the homicide penalty from the penal code in the event that a woman is assaulted and loses her unborn baby as a result....”
Malliotakis is shifting the discussion away from what the real news of the day about the overturning of Roe v. Wade is to >>> the policies contained in NY's 2019 Reproductive Health Act, which allows "practitioners" to perform an abortions on patients who are 24 weeks or more away from the beginning of their pregnancy, but only if the fetus is not viable or the abortion is needed “to protect the patient’s life or health” [which can be almost anything].
Back in early May, shortly after the draft decision of Justice Alitto had been leaked, the Staten Island Advance noted that >>> ".... When asked where she stands on the matter of overturning Roe v. Wade, Malliotakis deflected, referring to it as being a judicial matter.... 'This is a decision for the Courts not politicians,' she told the Advance/SILive.com. 'However, if reverted back to the states, New York’s extreme late term abortion law that allows abortion up until birth and ends criminal penalties for those who assault a woman, killing her baby, will sadly remain. I voted against that law as a state legislator.'... The congresswoman, who is currently running for re-election to her seat in New York’s 11th Congressional District, went radio silent when repeatedly asked specifically if she is for or against the overturning of Roe v. Wade...."
UPDATE & BACKFILL: THE "FOR THE RECORD" EDITION
ReplyDeleteTHE FORMAL NAME OF THE CASE THAT MOMENTOUSLY OVERTURNED THE "ROE V. WADE" DECISION IS "THOMAS R. DOBBS, STATE HEALTH OFFICER OF THE MISSISSIPPI DEPARTMENT OF HEALTH, ET AL., PETITIONERS - V. - JACKSON WOMEN'S HEALTH ORGANIZATION, ET AL.".....
The majority opinion was authored by Associate Justice Samuel Alito; and his decision will probably become popularly known as "Dobbs v. Jackson" or the "Dobbs Case".....
Justice Alito's opinion begins with this: “Abortion presents a profound moral issue on which Americans hold sharply conflicting views. Some believe fervently that a human person comes into being at conception and that abortion ends an innocent life. Others feel just as strongly that any regulation of abortion invades a woman’s right to control her own body and prevents women from achieving full equality. Still others in a third group think that abortion should be allowed under some but not all circumstances, and those within this group hold a variety of views about the particular restrictions that should be imposed.”

ReplyDeleteARE NICOLE MALLIOTAKIS, VITO LA BELLA & BRIAN FOX TRUE "FAMILY VALUES" & "PRO-LIFE" REPUBLICAN CONSERVATIVES ?????
OR >>> ARE MALLIOTAKIS, LA BELLA & FOX JUST POSEURS ???????
THE BIG POLITICAL ISSUE OF THIS WEEKEND IS THE U.S. SUPREME COURT "DOBBS" DECISION THAT OVERTURNED "ROE V. WADE" --- MALLIOTAKIS HAS BEEN AND CONTINUES TO BE EVASIVE --- AND FOX & LABELLA HAVE BEEN SILENT ABOUT IT
As time goes by, it has become increasingly clear that the GOP and the Conservative Party don't do any serious vetting of their candidates for conservative beliefs in any way.
As a result, when something momentous happens like the "Dobbs v. Jackson" decision that wiped out both "Roe v. Wade" and "Casey" >>> we can't tell whether folks like Nicole Malliotakis, Vito LaBella, and Brian Fox applaud that decision by Justice Alito, or are they appalled by it.
Before we contribute to, work for, or vote for these pissant politicians, we should know what their positions are on abortion and many other issues relevant to social conservatives --- OR --- to reiterate the question raised in our headline to this comment, we all need to ask >>> "WHERE DO THEY STAND ???"

ReplyDeleteNET-NET --- REPUBLICAN-CONSERVATIVE CANDIDATES THAT ARE TAKING A NEUTRAL STAND ON THE "DOBBS V. JACKSON" -- "ROE V. WADE" BROUHAHA WILL >>> LOSE <<< VOTES IN NOVEMBER AS A RESULT OF THEIR PASSIVE SUPPORT OR OPPOSITION TO WHAT THE SUPREME COURT HAS DONE IN "DOBBS"
MEANWHILE --- THE VOCAL OPPOSITION TO WHAT THE SUPREME COURT HAS DONE IN "DOBBS" IS ON THE ATTACK AGAINST WHOM THEY SEE AS A TARGET OF OPPORTUNITY, BECAUSE SHE IS VULNERABLE ON THE ISSUE >>> MEMBER OF CONGRESS NICOLE MALLIOTAKIS
According to the NY Post over the weekend, ".... In Brooklyn, former Rep. Max Rose, Councilman Justin Brannan and other local Democratic pols joined abortion-rights advocates outside Rep. Nicole Malliotakis’ Bay Ridge office to protest Republican’s pro-life policies and her decision last year to vote against making abortion protection through the Roe case law instead of a precedent of the Supreme Court.... Many of the 100 who attended chanted 'Vote her out!' Others held signs that included slogans like 'Nicole Failed NY'.... Rose, who is seeking to reclaim Malliotakis’ congressional seat representing Staten Island and part of southern Brooklyn, accused his opponent’s politics of hurting Americans.... 'We are going to go forward as a country, not backwards,' he said...."
For Nicole's response to the NY Post coverage >>> well, it was feckless, jejune, and frankly, quite pathetic.....
According to the reporters at the NY Post, ".... Malliotakis did not address the Roe decision but said she was concerned that New York’s late-term abortion law wasn’t affected. 'When Max Rose was in Congress, he voted against amending the bill to at least require medical care for a baby that survives a botched late-term abortion,' she said...."
NICOLE, IS THAT THE BEST YUH GOT ?????
That's called dithering and blithering. Nobody supports that in any way.....

WITH LITTLE CAMPAIGNING TIME LEFT --- LEE ZELDIN SEEMS TO BE A LITTLE AHEAD --- BUT ANDREW GIULIANI IS WITHIN STRIKING DISTANCE.....
According to the NY Daily News, ".... The Republican race for governor looks up for grabs in the late hours, with limited recent public opinion polls showing Rep. Lee Zeldin holding a narrow lead over Andrew Giuliani ahead of Primary Day on Tuesday.... Zeldin, a Long Island lawyer who has the support of the state Republican Party, topped Giuliani, son of former Mayor Rudy Giuliani, by 7 percentage points in an online survey conducted by John Zogby Strategies last week.... Zeldin and Giuliani have rushed to the right during the primary, running as anti-abortion, pro-Trump Republicans who are quick to rip pandemic health measures.... The winner of the race is expected to serve as the underdog in the general election for governor; Democrats outnumber Republicans in the state by more than two to one...."
Here's what I know: the Supreme Court overturning Roe was the biggest victory for the Catholic Church in a half century. Meanwhile, John Quaglione, the alleged press secretary for the Brooklyn Diocese, is on Twitter complaining about trucks parking on a street where no one else parks. It's no wonder Paula Katinas is his boss.

ReplyDeleteTHESE SO-CALLED REPUBLICAN-CONSERVATIVE CANDIDATES THAT ARE TAKING "A PASS RATHER THAN A STAND" ON THE "DOBBS V. JACKSON" DECISION THAT OVERTURNED "ROE V. WADE" ARE SHOWING THAT THE ARE DEFINITELY MORE R.I.N.O. THAN REAL CONTEMPORARY REPUBLICAN-CONSERVATIES
THE WAY THINGS LOOK NOW, NICOLE MALLIOTAKIS, BRIAN FOX AND VITO LA BELLA ARE LETTING STRONG RIGHT TO LIFE -- SOCIAL CONSERVATIVES KNOW >>> THAT THEY ARE UNDERSERVING OF THEIR VOTE >>> FURTHERMORE, THEIR STEALTH ON THE ISSUE MEANS THAT THEY WILL BE LOSING THE SUPPORT OF MANY NECESSARY RTL-CONSERVATIVE VOTERS IN NOVEMBER.....
AS A RESULT OF MALLIOTAKIS', FOX', AND LA BELLA'S PASSIVE SUPPORT OR OPPOSITION TO WHAT THE SUPREME COURT DID IN "DOBBS" MEANS >>> THAT FOLKS LIKE MAX ROSE, ANDREW GOUNARDES, AND IWEN CHU WILL BE GETTING A STRONG PRO-CHOICE-PROABORTION VOTE, WHILE THE BACKSLIDING REPUBLICAN-CONSERVATIVE CANDIDATES WILL BE HEMORRHAGING THE VOTES OF RTL-SOCIAL CONSERVATIVES
One has to wonder >>> Why is the current crop of GOP-Conservative candidates is finding it so hard to be solidly Pro-Life Republican-Conservatives ?????
The Brooklyn GOP backed Zeldin. Sliwa and Capano bacjed Giuliani. Less than an hour before they beat Ghorra and take Giuliani to victory.
ReplyDeletePut your dreams away for another day
ReplyDeleteUPDATE & BACKFILL: THE "ASSININE TWINS" EDITION
ReplyDeleteBRIAN FOX AND ANDREW GOUNARDES ARE MADE FOR EACH OTHER
THE INTELLECTUALLY CHALLENGED STATE SENATOR GOUNARDES SAID SOME REALLY STUPID STUFF ABOUT THE SUPREME COURT LATELY --- BUT DUMB AS DIRT BRIAN FOX COULD NOT STAND TO BE OUTDONE.....
FOX EVEN COMPLAINED TO THE FBI THAT GOUNARDES NEEDED TO BE INVESTIGATED FOR THREATENING VIOLENCE AGAINST SUPREME COURT JUSTICES, INCITING INSURRECTION, AND CLEARLY MENTIONING SOME KIND OF TERRORISM..... [A COPY OF FOX'S LETTER WAS ALSO PURPORTEDLY SENT TO THE BROOKLYN DA'S OFFICE]
Anybody reading Fox's purported letter to the FBI, dated June 28th, would surely have to wonder >>> if it actually might be Brian Fox that needs to be investigated for a possible violation of 18 USC 1001..... That's because Fox himself and his campaign apparently have made a false charge against Gounardes involving domestic terrorism; specifically, "... for the invitation and promotion of violence against Justices of the United States Supreme Court...."
The applicable federal statute covering Fox's letter to the FBI provides the following [among other matters]: "... [W]hoever, in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully -- (1)falsifies, conceals, or covers up by any trick, scheme, or device a material fact; (2)makes any materially false, fictitious, or fraudulent statement or representation; or (3)makes or uses any false writing or document knowing the same to contain any materially false, fictitious, or fraudulent statement or entry.... shall be fined under this title, imprisoned not more than 5 years or, if the offense involves international or domestic terrorism (as defined in section 2331), imprisoned not more than 8 years, or both. If the matter relates to an offense under chapter 109A, 109B, 110, or 117, or section 1591, then the term of imprisonment imposed under this section shall be not more than 8 years...." (See "18 U.S. Code § 1001 - Statements or entries generally").
Since Fox and at least one campaign aide, Michael DeMartino, Jr., have doubled and tripled down on these charges with a "media advisory" for immediate release, also dated June 28th, and on print and video social media >>> charges for violations of federal conspiracy statutes, as well as wire and mail fraud might also be appropriate.
Fox never heard the one about glass houses and stones

ReplyDeleteYET AGAIN, THESE SO-CALLED REPUBLICAN-CONSERVATIVE CANDIDATES ARE TAKING "A PASS RATHER THAN A STAND" ON THE "DOBBS V. JACKSON" DECISION THAT OVERTURNED "ROE V. WADE"
THEIR OWN ACTIONS, OR MORE ACCURATELY "NON-ACTIONS" ARE SHOWING ALL OF US THAT THEY ARE DEFINITELY HARDCORE R.I.N.O. PRAGMATISTS RATHER THAN REAL CONTEMPORARY REPUBLICAN-CONSERVATIES
CLEARLY, NICOLE MALLIOTAKIS, BRIAN FOX & LA BELLA ARE LETTING STRONG RIGHT TO LIFE SOCIAL CONSERVATIVES DOWN --- BIG TIME !!!

ANDREW GIULIANI HAD SUBSTANTIAL SUPPORT THROUGHOUT NYS --- HOWEVER, HE EASILY CARRIED THIS INDEPENDENT REPUBLICAN BLOG'S AREA OF LOCAL INTEREST, BROOKLYN & STATEN ISLAND....
OBVIOUSLY, THE RESULTS FOR ZELDIN & GIULIANI REFLECTED THE RELATIVE STRENGTH AND INFLUENCE OF THOSE SUPPORTING EACH CAMPAIGN --- SO, IN BROOKLYN AND STATEN ISLAND THAT MEANS THE GIULIANI SUPPORTERS WERE CLEARLY STRONGER AND/OR WORKED HARDER THAN THOSE FOR ZELDIN
SINCE THE BROOKLYN GOP ORGANIZATION AND SEVERAL OF ITS CANDIDATES SAID THEY BACKED LEE ZELDIN --- CLEARY, THEY DID NOT DELIVER --- THAT'S DEFINITELY NOT A GOOD LOOK COMPARED TO THE MAIN BROOKYN GOP FACTION SUPPORTING ANDREW GIULIANI [SEE THE BROOKLYN GOP PRIMARY VOTE FOR GIULIANI & ZEDLIN, BELOW]
Statewide GOP Primary result:
Lee Zeldin ... 195,051 ... 43.9%
Andrew Giuliani... 101,308 ... 22.8%
Rob Astorino ... 82,373 ... 18.6%
Harry Wilson ... 65,327 ... 14.7%
Brooklyn GOP Primary vote for Giuliani & Zeldin:
Lee Zeldin ... 3623 ... 33.4%
Andrew Giuliani... 5268 ... 48.6%
Staten Island GOP Primary vote for Giuliani & Zeldin
Lee Zeldin ... 4291 ... 30.1%

ReplyDeleteAll those nobodies that supported and voted for Zeldin need to care. If Zeldin's folks don't build some bridges to all the GOP somebodies that voted against him in Brooklyn and Staten Island, he's got no chance against Hochal this fall. Right now, he's not even got an uphill fight >>> the Zeldin team is upside-down and sideways, with less than 50% of Republicans onboard yet. Locally, in Brookllyn and Staten Island Zeldin lost outright to the Giuliani team.

THEIR "NON-ACTIONS" & SILENCE ON THE ISSUE ARE SHOWING EVERYBODY THAT FOX, LA BELLA, AND MALLIOTAKIS ARE AT BEST R.I.N.O. PRAGMATISTS --- RATHER THAN REAL CONTEMPORARY REPUBLICAN-CONSERVATIVES
BY THEIR RELATIVE SILLENCE --- NICOLE MALLIOTAKIS, BRIAN FOX & LA BELLA ARE DELIVERING A STAB IN THE BACK TO STRONG RIGHT TO LIFE SOCIAL CONSERVATIVES.....
THAT MEANS THEIR STEALTH ON THE ISSUE SHOULD & WILL LEAD TO A SIGNIFICANT LOSS OF SUPPORT BY MANY NECESSARY RTL-CONSERVATIVE VOTERS IN NOVEMBER.....
It's been more than a week since the Supreme Court's decision in the case, "Dobbs v. Jackson," overturned the constitional protections for a woman's right to choose abortion created by the Supreme Court in "Roe v. Wade"..... Malliotakis, Fox and LaBella have not taken any stand whatsoever on their support or opposition to the "Dobbs v. Jackson" decision and its consequences.
