Tomorrow is the next big day in the Vetrano-Lewis murder case --- as everybody will have their say on how to go forward


Supreme Court Justice Michael Aloise has ordered all sides involved in the prosecution of Chanel Lewis for the murder of Karina Vetrano to appear in his courtroom in Queens tomorrow to discuss how the case will proceed

There has been little  >>> NEWS <<<  in the case since Judge Aloise, in a very controversial ruling (one of very many in the case),  declared a mistrial on November 20, 2018.....   What was reported at the time suggested that the trial judge rushed to his ruling upon the defense motion without giving the jury what is called an "Allen Charge"  ---  urging the jury to renew deliberations and to cooperate in order to reach a verdict based upon the evidence presented to them.  However, it was only later reported that the Queens County prosecutor, a very senior ADA in the Office of the Queens DA  >>> DID NOT OPPOSE <<<   the defense motion for a mistrial



THAT LEAVES A RATHER OBVIOUS QUESTION GOING FORWARD  ---  WHY DID THE PROSECUTION DECIDE TO THROW IN ITS CARDS AFTER CHANEL LEWIS' DEFENSE  TEAM IN ESSENCE SAID  >>> IT LOOKS LIKE THE GAME IS UP <<< 

RIGHT NOW,  IT'S UP TO JUDGE ALOISE TO SEE WHEN AND IF HE'LL RE-DEAL THE CARDS IN THIS CASE


The following is a typical report after jury deliberations were abruptly terminated in the Vetrano-Lewis murder trial in the Queens courtroom of Justice Michael Aloise, JSC,  on November 20th 2018:
"....  A judge declared a mistrial late Tuesday in the murder trial of Chanel Lewis, the man accused of killing Queens jogger Karina Vetrano in 2016....   Following a day and a half of deliberations, the jury sent a note to the judge saying it was hopelessly deadlocked and had exhausted all thoughts and opinions....   The victim’s family was stunned, with the judge announcing the hung jury to a near-silent courtroom. Several were in tears as they were escorted out....  Lewis, 22, is accused of killing the 30-year-old Vetrano while she was jogging in Spring Creek Park near her family’s home in Howard Beach. If found guilty, he faces up to life in prison. His attorney says the declaration goes to show the evidence presented was far from a slam dunk....  [various details about the history of the case and what was presented at the trial]....   Prosecutors say they’ll move to retry the case following the judge’s decision. Lewis will remain in jail as the case is adjourned until January 22nd, when the two sides will reconvene and figure out how to proceed"

TWO WEEKS LATER,  THE NY TIMES PAINTED A COMPLETELY DIFFERENT PICTURE THAN ALMOST ALL OF THE PRIOR REPORTS

Here's some of what the New York Times said a couple of weeks after the declaration of a mistrial by Justice Aloise:

"....  The Queens district attorney’s office believed its case against Chanel Lewis was airtight. Prosecutors had a videotape of Mr. Lewis confessing to the murder of 30-year-old Karina Vetrano two years ago as she jogged through a Queens park. Police had also found his DNA on her body.  But after a two-week trial last month, the unexpected happened: The jury remained hopelessly deadlocked after only two days of deliberations. The judge quickly declared a mistrial. Prosecutors did not object....   Usually, a videotaped admission of guilt coupled with DNA evidence almost guarantees a conviction. But the Vetrano case demonstrated that jurors are starting to doubt such evidence....   Over the last 20 years, several cases involving false confessions have surfaced, and DNA evidence, while seemingly convincing, has not always persuaded jurors who have concerns about police integrity. The skepticism is higher in minority communities where relationships with law enforcement have been strained, legal experts said...."  (See  "The Murder Case Seemed Solid. MORE THAN ANYTHING ELSE, THE PROSECUTION/ PERSECUTION OF CHANEL LEWIS HINGES ON RACE

Perhaps, an even more important bit of the report by Timesperson Jan Ransom was a segment in  her article where she detailed her investigations into how the jury had become "hopelessly deadlocked"  ---  "....   Several jurors agreed with the defense’s argument that Mr. Lewis’s confession might have been coerced and that DNA evidence could have been contaminated, according to one juror, who spoke on the condition of anonymity for fear of harassment....  The juror’s account could not be independently confirmed, but it meshed with what transpired in court and with evidence the jury reviewed during deliberations. Two other jurors declined to comment, while several more did not respond to requests for an interview....   The juror said all panel members agreed early on that prosecutors failed to prove beyond a reasonable doubt that Mr. Lewis, 22, had sexually assaulted Ms. Vetrano, but the jury remained split about whether Mr. Lewis was guilty of murder....   Seven members wanted to convict him, according to the juror, including all four white members of the panel, a Hispanic woman, an Asian man and a black man....   The five people who had doubts about his guilt were of black, Hispanic and Indian descent.  Some jurors were troubled by how Mr. Lewis, who is black, became a suspect in the first place, the juror said. He was arrested on what amounted to a hunch from a police lieutenant, who, months before the murder, had seen him “acting suspiciously” as he wandered through Howard Beach, a mostly white neighborhood where the murder happened...."

  3. The Vetranos are covering for something or somebody. They immediately had Karina's body cremated; and Phil spent the better part of a year completely destroying the crime scene, calling it a secret memorial garden for Karina.

  7. 3:04, Phil Vetrano 'contaminated' the crime scene with DNA and god knows what else on the night when he 'discovered' his daughter's broken and only partially clad body. It was not far from where he said he had gone to look for her earlier that evening, when he says he was first concerned that something had happened to her.

    Sometime after his daughter was killed and long before Chanel Lewis had been charged with her murder, Phil Vetrano personally started to completely rearrange the so-called 'crime scene', cutting down weeds, creating new paths, moving in several large stones and putting down new gravel and mulch. That's what I meant about his 'destroying' the crime scene for the better part of a year after her murder.

    The long and the short of it, is the Vetranos worked very hard doing anything that they could to destroy any remaining evidence that they thought could be related to their daughter's murder. The only question I have is this: WHY?

He is with Eric now because has a good deal, as soon as it starts falling apart he will move on to the next enterprise just like all Brooklyn conservatives. Next project is see if he can get Ted to go along with him becoming the new GOP Chair while telling Nicole he was with her all along and was actually working against Eric. Marty doesn't want to be Brooklyn Chair, it's time for everyone to bury the hatchet at least temporarily and get together for the survival of the Brooklyn GOP. It's time to tell Liam and Ted and their boss Jerry to take a hike from the Brooklyn GOP for once and for all.

    According to the report by the editor of the Queens Chronicle, "A new trial for the man accused of murdering Howard Beach jogger Karina Vetrano is now set to begin March 12....
    The same Queens judge who called a mistrial last November after a jury deadlocked over the 22-year-old Chanel Lewis’ guilt or innocence said today that both sides should be ready to begin jury selection in six weeks...."     Strangely, the Queens Chronicle reported that "[Phil Vetrano] said he is 'both glad and disappointed' to have a new trial date.... 'Glad that we can get on with it now and disappointed we have to go through it again.'..."'

    Those sentiments don't seem to jibe with a competing report in "amNY"..... According to a little portion of amNY's report on today's court proceedings in the Vetrano-Lewis murder case. ".... [The trial judge, Michael] Aloise received some criticism in the media for declaring a mistrial so quickly without giving the jurors more time to deliberate [in late November 2018]. But law enforcement sources said that both the prosecution and the Vetrano family agreed before the mistrial was declared that with such a deep split evident among jurors further deliberations would be pointless.... Outside court on Tuesday, Philip Vetrano, the victim’s father, said he was happy a date was finally set for the retrial but voiced discomfort with the fact that he and his family had to sit through the evidence again...."     To the undiscerning, there might appear to be no difference in what Phil Vetrano was saying to the Queens Chronicle and to "amNY" --- but on the issue of his having to go over the "evidence" one more time in court, it makes all the difference in the world to Phil Vetrano.

    Lest there be any doubt, the amNY article immediately followed Mr. Vetrano's equivocal comment very provocatively with this trenchant observation by its reporter, Anthony diStefano: "During the first trial the prosecution displayed graphic crime scene photos of the 30-year-old Vetrano’s battered body when it was found in Spring Creek Park, where she had gone jogging the evening of Aug. 2, 2016. Philip Vetrano testified at the first trial about finding his daughter’s body in the weeds with police the night of the killing. He is expected to testify again in the second trial."

The hack writer at AM NY quotes "law enforcement" sources as saying they joined in request for mistrial because these law enforcement sources knew the jury was never going to move off the 7 to 5 split. Did those law enforcement sources have a bug in the jury room? The New York Times interviewed a juror who said jury was 12 to 0 for not guilty on sex crime.

    The Queens DA seems to win in the press but loses in the courtroom.

The still-incarcerated suspect, speaking Tuesday to the Daily News, again insisted on his innocence in the Aug. 2, 2016, homicide of 30-year-old Karina Vetrano near her Queens home.... 'No,' he replied when asked if he was the killer. Lewis offered the same reply when asked if he had assaulted the victim, who lost some of her teeth in the vicious attack by a predator lurking in the weeds.... 'I’m looking forward to being acquitted,' Lewis told the News.     Clearly, this Daily News interview did not happen without the Chanel Lewis defense team being completely onboard. As such, it constitutes their first attempt to get out in front of the prosecution side in this case with some positive spin of their own in the ongoing saga of the Vetrano-Lewis murder case.

    For almost two whole years the NYPD, Queens prosecutors, and the NYC Office of the Medical Examiner have been alone spinning like dervishes in the run-up to the Karina Vetrano murder case; and when the trial finally came, that spin was shown up for what it was --- nothing that would hold up in front of a real live jury in a real live court trial. The prosecution initially signalled the weakness of their case when they moved to dismiss a majority of the charges against Chanel Lewis. As to the charges that were left, the interviews with the jurors and alternates after the trial showed that a badly hung jury was the best that the prosecution could hope to get the first time around, given how those charges were fleshed out by the best evidence that the prosecution could muster and present. What's more, if the jurors had been pressed for a verdict, a complete acquittal would have been a very likely outcome.

    The Daily News interview is a leading indicator that in the re-trial the defense intends to use more of what it has, and take it to the prosecution given what they have from the record of the first trial, and a bundle of evidence that wasn't allowed to be given to the jury because of a hyper-technical ruling by Judge Aloise from the first trial.

  37. Manny was more likeable until he started mocking CUNY and the working class men and women who put themselves through college nights and weekends while working a fulltime job.

    Ulrich may have a base, but it's puny, and nowhere near the name recognition Sliwa had.

    Sliwa's weakness was being dumber than rocks when it came to petitioning and pre=clearing his candidacy with his employer.

  40. Gale other reasons may exist for the silence of Chanel Lewis and his attorneys. Recently another high profile hung jury involving ex nassau county exec Ed Mangano ended with his lawyers telling the press the jury found the prosecution witness was not credible. Manganos lawyers were then hit with a gag order. The next time an article appears the Judge will remove Manganos lawyers.

    I know from speaking to those involved that Lewis defense team is rolling over the prosecutor Brad Leventhal and Judge Aloise knows it. Pause and look at this confederacy of dunces. The cops, DA, Judge all get together for a linching and the rope breaks.

Earlier in the tale, Lynch's son is reported to have confessed to murdering a Spanish merchant sailor in the care of the family. The Spanish sailor was thought to have romanced the younger Lynch's fiance. When no one in Galway could be found to carry out the execution of young Lynch, Judge/ Mayor Lynch hanged his son himself (or "lynched" as the practice of summary hanging became known around the world after this event). A memorial of all that is now embedded in stone in an old wall above a Gothic doorway on Market Street near the graveyard at St. Nicholas’s Church in the City of Galway, it's very close to the home and museum of Nora Barnacle, James Joyce's wife and muse. In the same old wall containing Lynch's Memorial, there is a small old window called "Lynch's Window" --- some say that Lynch pushed his son out that window with a rope around his neck; but it is a very small window, so I doubt it.

    Please note, "... AT 10:07 AM," I take no issue with your referring to what is being done to Chanel Lewis as a "lynching" --- it's only the spelling, which I used as an excuse to give an Irish history lesson and travelogue....

Liam or Will McCabe's personal demons should be enough to eliminate him from any thought as a real Brooklyn GOP leader,  but if there was any doubt once Ulrich goes down in flames on Feb. 26 that will the final nail in his political coffin.  After all, if you are going to declare war on Brooklyn's only GOP elected official, Nicole Malliotakis,  you better win. He will not. And why did McCabe change his name??? Have we got an answer GM?

Eaton and Capano are already on board with Nicole and she has had very good conversations with both of them recently that went a long way towards clearing the air and resolving instigated misunderstandings. Only thing anybody curious about with Liam is how long he will continue charade trying to have it all ways by claiming to support Eric, Nicole, and Grimm. One of the key Grimm supporters on SI already called them out on it telling them to pick a side. Of course they are just waiting to see who wins once the dust settles and then expect Mike Long and Jerry to get them hired. That treat has reached its expiration date, the late 90's are over and besides, word is Mike Long would rather have Eaton's relatives hired than Liam.
