NYS Supreme Court Justice Michael Aloise did everything he could to hang Chanel Lewis out to dry


Judge Michael Aloise served up a lot of "home cooking" for the Queens DA's Office during the Chanel Lewis trial  ---  what do you expect from somebody with so many connections to that office and the Queens County political establishment


Not only did his ordering a mistrial in the Vetrano-Lewis case pull the fat out of the fire for the prosecution, his earlier evidentiary rulings and strict limitations on the defense's cross-examinations of prosecution witnesses kept the Chanel Lewis team from presenting their best case  ---  and the good Queens machine judge was covering his own ass for a very flawed trial,  one that was  rife with reversible error.....



For all of their song and dance, and dog and pony tactics,  the NYPD and the Queens DA's Office could not produce a single piece of evidence that Chanel Lewis was present at the time and place of Karina Vetrano's murder  ---  except for what has clearly been shown to be a coerced and very problematic "confession" by an intellectually challenged young person with special needs, who was first placed in isolation and then "interrogated" overnight without legal representation or any other adult representative present.

So far I have done plenty of commentary on the weaknesses of two parts of the "open and shut case" against Chanel Lewis  ---  first,  the ersatz DNA "matches" to Chanel Lewis found in three places on  Ms. Vetrano and/or on her personal possessions;  and second, the questionable confession by the Defendant Chanel Lewis,  which seems to have all of the facts wrong about the way Karina Vetrano was murdered and/or  how murder scene looked.  Now, let's look at some of the evidence that was not allowed to get to the jury that might have firmed up their joint several and  collective inclinations to acquit the Defendant Chanel Lewis.

First, the trial Judge, Michael Aloise, didn't allow the defense to question prosecution witnesses about the many thousands of hours of video tape of the various approaches to Gateway Park,  none of which showed a picture of the defendant entering into, or even at any location near Gateway Park, or exiting from it, at any time relevant to the murder of Karina Vetrano.

Next, we have had a chance to look into a defense analysis of vectors from the various cell towers around East New York and Howard Beach that would have yielded information that, if not clearly contradictory to similar prosecution evidence showing Chanel Lewis might have been near the murder scene, would have yielded  an equal probability that Chanel Lewis was in a Brooklyn Park several miles away from the Vetrano murder scene at or near the time that Karina Vetrano was murdered in Gateway Park near the edge of her Howard Beach neighborhood. However, Judge Aloise would not allow the defense to question prosecution witnesses about the pings on vectors to a Brooklyn  site where Chanel Lewis said he was around  the time of Karina Vetrano's murder ( See "Karina Vetrano Murder Trial Wraps Up After Judge Blocks Video Evidence" by Max Rivlin-Nadler,  11/19/18,  Gothamist   [http://gothamist.com/2018/11/19/chanel_lewis_video_evidence.php]).  

When the defense attempted to get the favorable cell tower information into evidence using an investigator, the testimony was cut off on a narrow issue of discovery and disclosure, because the investigator was referring to investigator's notes, and those notes had been demanded by the prosecution, but had not been turned over prior to the investigator's attempted testimony.

In addition to the cell tower evidence favorable to the defense,  there was another "eye witness," whose testimony was blocked by the trial judge, Michael Aloise.  According to the Gothamist report by Max Rivlin-Nadler,  "...  a Verizon employee who was working on a telephone pole along the path that Lewis told investigators during his confession that he had used to enter the park [was expected to testify that he] never saw Lewis enter or leave the park during the time the murder took place...."   As with so many other rulings in this case, Queens County Justice Michael Aloise sided with the Queens County DA  ruling that the Verizon employee’s testimony had “no relevance whatsoever,” and that it would needlessly prolong the trial.

  1. The pattern in all of these bad decisions by the Judges is they have sons or daughters working in the district attorneys office. It may sound petty that a Judge would toss a case so his kid can make a few bucks in a government job but none of these Judges were exactly captains of industry before they became Judges. In Brooklyn Judge Matthew D'emic is in charge of all the criminal cases while has a son working in Brooklyn DA's office.

    Queens is the new Brooklyn.

    This move had been long predicted, because DA Richard Brown had developed a nickname lately of "Out-a-Town" Brown --- in spite of the beauchoise (Pronounced "booh-swhehsh") PR that he was in the office early every morning.

    Things really took a turn to the south, when Brown's top underlings (what a concept) blew the prosecution of Chanel Lewis for the murder of Karina Vetrano. Their sins far exceeded their normal terrible prosecutorial ethics, especially at trial with the help of the trial judge; their biggest faux pas was grossly overselling the case against Chanel Lewis as a "slam dunk", when the reality was that it was a weak case that leaked like a sieve, and the jury saw that right away.

    This Vetrano case should be a big item of debate in this Democrat Primary, with the future Queens DA (candidates) being made to say "Yay" or "Nay" to this proposition: WHEN A WHITE WOMAN IN HOWARD BEACH IS MURDERED, AND THE COPS AND THE QUEENS DA CAN SOLVE THE CASE IN SIX MONTHS, IT IS PERFECTLY ALRIGHT TO RAILROAD A MENTALLY CHALLENGED KID, WITH NO RECORD OF VIOLENCE OR ANY CRIMES WHATSOEVER, AS LONG AS HE'S FROM A "HIGH CRIME" (MEANING BLACK) AREA IN BROOKLYN.

    Let's see if anybody tries to get the re-trial of his case going anytime soon --- OR WHETHER --- The DA's Office decides to quickly tank the case with an offer no defendant like Chanel Lewis (one stuck indefinitely in jail with no bail) could refuse.

    MAYBE I'M THE LAST TO KNOW --- BUT HERE'S HOPING SOME OF YOU OUT THERE HAVEN'T HEARD THIS ONE YET.....


    I heard from one of my BSIs with friends at the BOE that there was a slight kerfuffle, maybe even a bit of a scuffle, at the Board of Elections on Monday past; and Bay Ridge's very own "Peck's Bad Boy" Liam might have been in the middle of it.

    The story goes like this: Liam McCabe was sleeping-in somewhere around the BOE so he could be the first guy on line to hand in some of the Eric Ulrich petitions. Well, turned out that Ydanis Rodriguez had a few of his Dominican types sleeping in a car outside planning to do the same thing. When the jockeying started for the actual lineup at the BOE, some sort of brawl broke out.

    Plus, the word is that somebody officially complained about Liam's antics; and some kind of BOE measures are afoot --- not to worry, it'll probably be a-foot-and-a-half at the most.

    More important than any of that, William (now call me "Liam") McCabe is no kind of "leader," in any sense of that word, as the short-time "Republican" that he is.

    Somebody needs to fine tune this picture for me and my readers (because there has been some dispute about it). I have been told by a reliable apologist for Jerry Kassar (and others that dispute that person's version) that Liam was ushered out of the NYS Conservative Party by one of the following means: 1) a solid kick in the ass with a hobnail boot, with a strong suggestion that his future prospects would be better elsewhere; 2) a clever ruse, one involving a "deal" for support in a race for the City Council as the GOP-Conservative Party nominee; 3) having several realistic conversations about what Jerry Kassar and Mike Long hoped they might do-for and expected-from Liam in the future; or 4) by simply moving the Conservative Party's "Welcome" mat next to the exit door.

    I remember a brief discussion with Liam in 2017 about his becoming a "Republican" after so long being an activist as a "Conservative." What he described looked and sounded like a "default setting" switch of search engines on a computer. So, if you think it's that easy, what I am about to say won't mean very much to you.

    Liam McCabe is not ready to exercise any leadership in the Republican Party in Brooklyn, because he has never exercised any followership in the Republican Party in Brooklyn. Or to put it in a somewhat different context, when you are thinking and acting as if "...build it and they will come..." is your primary tactic and/or strategy, then you have to "...build it..." first.

    So far Laim hasn't built anything as a Republican.

    I remember a very active GOP club on the edge of Park Slope that stood like a strong oak in a district that was a mostly Democrat forest. --- That GOP club was strong, had a solid County Committee slate, and waved the GOP flag proudly in a tough AD. In some elections, it delivered the majority of votes in many of its EDs in Windsor Terrace, Kensington and Parkville. "... But that was once upon a time, now the tree is gone..."

    Like I said, the Brooklyn GOP needs a few real clubs, with real district leaders and real club presidents..... Not clubs that are like cut-outs of foam poster board set-up in some Odeon multiplex lobby, like the "Verrazano" Club, with or without its two "Zs".....

It’s time to put some other real villains behind the Karina Vetrano fiasco from the Queens DA’s Office in the hotseat for the travesty of the persecution of the mentally challenged black Brooklyn youth, Chanel Lewis, that a majority of jurors saw was a phony right away in November 2018. I mean Chief Assistant DA John M. Ryan and his sidekick, Vincent J. Carroll, Jr., Counsel to the Chief Assistant District Attorney.

    There is no way that a scoundrel like trial ADA Brad Leventhal could have pulled the crap that he did to Chanel Lewis before, during and after the trial without Ryan and Carroll signing-off on every bit of it.

    One of the things that this year’s crop of DA candidates needs to talk about is how soon they’ll give Ryan, Carroll and Leventhal the boot once/if they are elected.

  34. The Queens DA's office needs to be reformed, depoliticized and streamlined. As a matter of form, the organizational chart is ridiculous. In practice there is no efficiency whatsoever, and there are so many bosses that authority is diffused and in some instances responsibility disappears completely.

    It all started from the top with DA Brown's deciding to end his career as QUeens DA with a slow, slow, slow, slow retirement over the last ten to twelve years. Richard Brown was six foot two, young and handsome when he was last effective as the Queens DA; now look at him, and look at the office.

    Former Supreme Court Justice Gregory Lasak has more than a passing relationship with the disgraced former Brooklyn DA Charles Hynes..... The tip-off came in a recent article that mentioned how Phillip Smallman spoke up for the Queens jurist, both back in the day and more recently.

    I did a little digging and somebody has promised me some dirt about the Queens connections of Lasak, Smallman and Hynes. Don't forget, Hynes made his bones as a prosecutor in Queens trying another Howard Beach murder case --- but that time making sure that the people railroaded were local and white, because the victim was black and from Brooklyn.

    That is a strange case that has been too quickly forgotten.....

    The Griffith-Lester, Kern, Landone murder case has too many interesting parallels to Vetrano-Lewis murder case --- even if we exclude the common facts that both victims had left Howard Beach on the run, and that they were both killed after crossing over the bike path that rings Howard Beach. For example, in both cases a suspect higher on the list of probable perps was let go without any real case ever being presented against them; and key pieces of evidence were withheld from the jury that would have been exculpatory for the defendants.

    The known link between Joe Hynes and Greg Lasak is Phil Smallman who was on the Hynes team out of the Office of the Special Prosecutor.

  37. Gail, former Judge Lasak made that association himself in a local Queens paper sometime around October 2018 right before the Chanel Lewis trial was presided over by Justice Aloise, after Lasak had resigned to run for DA.

    By some strange distortion of history, Gregory Lasak claimed in an October 2018 article to have been in charge of or supervised the 1986 Howard Beach case of the murder of Michael Griffith.

    Lasak should be made to explain himself, because that prosecution was not done by the Queens DA. The case had to be taken out of the hands of the Queens DA's Office, because too many witnesses would not cooperate with the Queens DA, because of the alleged racism in the Queens DA's Office. As a result, Governor Mario Cuomo had to step in; and gave the case the Office of the New York Special Prosecutor, then headed by Charles Hynes.

    Lasak was handling the case when Queens DA Santucci had it taken away from him. Not sure why Lasak would point that out. But he is Polish.
    As for "witnesses" refusing to co-operate the only witness who refused was Dennis "Fat Fuck" Quirk who refused to turn over the car to ADA Lasak. The car was stashed in Quirks garage that took off after killing Michael Griffith. That was 1987 and many things have changed. Except Quirk is still a fat fuck. Hes even gotten fatter.

    It is odd that back in the day Mr. Quirk, one of the most powerful men in the New York State Court system, would have withheld a key piece of evidence in the Michael Griffith murder case from the Queens DA's Office --- until he received assurances that the driver of that car would not be prosecuted in connection with the killing of Michael Griffith --- and Mario Cuomo's hand-picked guy had been named the special prosecutor [too bad for Hynes that Dick Brown later became Mario Cuomo's guy to become the Queens DA].

    I'll bet that several of Dennis Quirk's Court Officers, past and present, would have a lot to say about the past and present Howard Beach Cases, some involving murders, others more mundane stuff like illegally operated scrap steel and auto salvage operations. Never forget, Quirk's power comes from the fact that he knows a lot of people and a lot of stuff about a lot of people.

So, why does Phil Smallman think that former Judge Lasak is a hero; isn't he one of Hynes' guys since his days as an assistant in the Office of Special Prosecutor, and much later, some stuff about a big Brooklyn murder case involving Hynes getting the Republican line in exchange for who knows what and one of the non-cooperating "persons of interest" becoming cooperative and an ADA for Hynes.

  41. It was both ADA diPietro and another very material 'non-cooperating witness', Smallman's client Albert Cleary, that were the key to the whole Hynes sham/scam prosecution in the Mark Fisher murder case in Brooklyn.

    Being part of a racist and corrupt legal system, like the one in Queens, for almost his whole adult life doesn't make him 'qualified.' If anything, it should make him unqualified, no, 'DISQUALIFIED.'

    During the time he was presiding over the murder case against Chanel Lewis, he was never a part of the solution, he was a big part of the problem team, including the Queens DA, the NYPD, and others who shall remain in the shadows, trying to keep a tight lid on the Karina Vetrano murder by lynching Mr. Lewis instead of the real perp(s).

  70. The irony here is that like him or not, Sliwa has higher name recognition than Ulrich and anyone else running.

    Had he been serious about the race, raised even a few bucks, and hired some professionals, Curtis could have snuck in on February 26. He'd be destroyed in November, of course. But beating 22 professional pols would have given him some bragging rights.

    Guess we are stuck with Viverito now.

  72. False starts and bad efforts in 'potential runs' doesn't raise anybody's profile, in the GOP or anyplace else.

    Sliwa's name recognition is not much better than 'Mudd'; if you don't know, look it up. Sliwa's lucky if he doesn't get carted off to a federal prison next.

    Neither Sliwa, Capano or anybody named Catsimatidis is taking over anything, each of them are still learning very basic lessons in insider GOP politics, and they are learning lots of things about each other.

    Let's see who it might be. The first comment put a knock on the conservatives, Ulrich and Marty Golden. The second mentions that 'somebody named Catsimatidis has taken over the Manhattan GOP'. And the third that 'there is no GOP in NYC, especially in Brooklyn'.

    In spite of an obvious internal contradiction, I think that it's just one person. That person said only one thing wrong, and two out of three ain't bad.

Ulrich appearance before the Verrazzano Club had 20 people and was live streamed, the Dyker event was so poorly attended there was a social media blackout.     B) If Liam's event were Schrodinger's one lone cat in a box with the radioactive poison etc, etc, etc... somebody connected to Liam would say that there were '90 to 100 people at Liams [sic] event' and that all '90 to 100 people' are simultaneously both alive and dead; and

    C) No matter how many people attended those conceptual conventions and gatherings of philosophers and/or quantum physicists all around the world throughout 2019 and 2020, would somebody connected to Liam say that there were 90 to a 100 people at those truly make believe and actually non-existent Liam [still sic] events?

    You may recall Tom cleverly persuades his friends to trade him small treasures for the privilege of painting the fence.

    Liam asked a group of District Leaders from around the county, most whom are nowhere near the Verrazano Bridge, to serve as advisors to the club, and help him run it.

    Lately, things aren't going great for him in the south and west end outposts of the Brooklyn Republican Party. The latest filings at the NYC FCB show that Eric Ulrich had only 20 donors combined in Bay Ridge and Dyker Heights. Just as bad as those numbers are, he only was able to raise about $1,900 combined from the contributions from those donors. That's really bad if you consider that Liam, Ted Ghorra and Marty Golden were supposedly behind the Ulrich fundraiser held at the Dyker Beach Golf Club.

    Ghorra came in with 3 electeds and we lost 2..both of whom were long time encumbents. He promised them the world as far as what he was doing for them, and they got destroyed.

    The Blood from the losses is on Ghorra's hands.

    He is the only one who thinks he shouldnt resign.

    Meanwhile Bob Capano continues to thrive as a Brooklyn Political Columnist recently speaking on political matters on some NYC radio stations while he continues as a business exec for a billionaire ..

    On again off again 'Republican' Bob Capano's on again off again radio showman candidate for Public Advocate, another on again off again 'Republican' Curtis Sliwa was a no-show with signatures at the BOE for the 2019 special election. This followed Capano's and Sliwa's on again off again stints as chairmen of the on again off again Reform Party, which after the 2018 election is a defunct (meaning off again) party in New York State.

    Meanwhile, Bob's supermarket boss, another radio showman, the on again off again 'Republican' candidate for mayor John Catsimatidis and his daughter Andrea, clearly a not yet again 'leader' of anybody inside the Republican Party have shown zero traction inside the GOP for any candidate in the 2019 special election contest for Public Advocate. That's not a very good starting point for any new on again off again candidacy for mayor in 2021 for big John Catsimatidis

    Why does anybody inside the Republican Party listen to the on again off again 'Republican' Bob Capano anymore? Lately, he has supported failed Republican candidates for mayor like John Catsimatidis and Nicole Malliotakis, while openly opposing Republicans like Marty Golden and Eric Ulrich.

At first he thought his puppet Ted could survive but switched to Liam when he realized Ted was done, now with the Ulrich fiasco blew up in their faces they are looking for another puppet and throwing Golden's name out there to discourage prospective candidates from stepping up.

    Who would have guessed that the early and mid-years of Craig Eaton's term as Republican Party Chairman in and for Kings County, especially around 2010, could have been looked back upon as "the good old days" ? There were two separate factions of "Young REpublicans"; the La Guardia Club was still a vital and going club in the old 49th AD; the Seergy CLub was standing tall in the old 46th AD; along with the still quite active TR Club in the relatively unchanged 44th; the Starace and Brownstone Clubs in the old 52nd; Russell Gallo and Phyllis Carbone waving the flag in the 47th and several other clubs working for Republicans across the districts bordering on Marine and Gateway Parks.

    There were hard and bitter fights in those days but there was still an active Republican Party with a real party infrastructure back then. And to that extent, we all should have been singing this along with Carly when Eaton was the Brooklyn GOP Chairman of yesteryear:

    ".... And tomorrow we might not be together
    I'm no prophet and I don't know nature's ways
    So I'll try and see into your eyes right now
    And stay right here 'cause these are the good old days...."
