DIANE HASLETT-RUDIANO COULDN'T REMEMBER VERY MANY KEY DETAILS ABOUT PRE-CONVENTION MEETINGS AT BAY RIDGE MANOR & CONSERVATIVE PARTY HEADQUARTERS
The evidentiary hearing conducted by Justice Edgar Walker ripped the scabs off some of the scabrous activities that happened in one not-so-strange and one very strange place right before the 2015 Brooklyn GOP convention. Several witnesses, including James McClelland, Diane Haslett-Rudiano and others who attended the problematic meetings testified about a pair of 11th hour meetings, one at the Bay Ridge Manor and the other at Conservative Party Headquarters.
The most critical and damning testimony given by one of the attendees at the pre-convention meeting at the Conservative Party HQ was largely unrebutted by the main witness for the Golden faction and a named party, Diane Haslett-Rudiano.
There also was substantial evidence submitted as to the reasons for the exclusion of a large number of proxies tendered by Martin Golden. One critical witness was Golden's staffer, and Queens County Republican, James McClelland. McClelland testified about initiating a problematic robo-call that was described as fraudulent and intentionally confusing to members of the Republican County Committee.

Did anyone see that marty golden is interfering in staten island gop politics? His YR club is having Janine Matera speak at their next meeting. Matera is running a primary against a sitting republican assemblyman that all si elected support- Ron Castorina. I hear Andy Lanza, Nicole Malliotakis, John Antonello, James Oddo are not to happy.

ReplyDeleteThe most important thing was how the Judge kept putting words in Golden's lawyer's mouth when he was making his last oral argument -- reminding him all that he was looking for and saying that the convention was being continued on the street-corner.
Somehow the fix is in with this judge, and U.S. Attorney Preet Bharara needs to look into this whole thing ASAP.
Bharra is busy working on indictments against Cuomo and DeBlasio. I don't think Preet really cares about the brooklyn GOP. I'm not sure anyone cares about brooklyn GOP.

Nonetheless, everybody agreed that there was ample material to put before the Appellate Court concerning the fraud, and fraudulent acts of the "Golden Faction" in obtaining the proxies that they tried to present at the 2015 GOP Kings County Convention.
A key witness had testified that State Senator Marty Golden's staffer, James McClelland, had bragged about fooling a lot of the County Committee members at a meeting right before the convention. Although McClelland denied what he had said, he admitted that he did send the fraudulent ROBO-CALL telling County Committee members that Golden's representatitves would be bringing the "Official Proxies" to sign -- McClelland also admitted in court that he knew there is no such thing as "Official Proxies" for the elected County Committee Members to sign.
A witness also testified that Diane Haslett-Rudiano had said she was busy "CLEANING" the Golden proxies the night before the convention. After a very vague and imprecise description of what "CLEANING" might refer to, Diane Haslett-Rudiano recounted that she was at some meetings in the nights before the convention, but she didn't have a clear recollection about what was done or said or even who was there. On the other hand, her recollection about the convention was quite precise even as to details she couldn't possibly have observed.
It is very interesting that Judge Walker wouldn't allow any questions about Rudiano's relationship with Marty Golden when it came to her holding her position and performing her functions as Chief Clerk at the Board of Elections -- even though Rudiano was a named party and she had filed the Golden faction's convention certification at the Board of Elections, and the very same Board of Elections had refused to certify the certification submitted by the "Official" Brooklyn GOP.
There's much more, but I've said enough, for now.

According to Ms. Cuba's report. "A top advisor to state Sen. Martin Golden (R–Bay Ridge) admitted in court on May 9 to sending out deceptive robocalls during last year’s contentious Republican party county chairman contest in an attempt to tip the scales for his boss’s preferred winner.... James McClelland, a political adviser to the Brooklyn pol, sent calls to party members ahead of a Sept. 30 convention implying ballots they had previously filled out were not valid and instructing them to toss their votes — called 'proxies' in political lingo — and wait for party leaders to send them the 'official' ballots.... 'Please do not sign and return the postcard proxy you recently received in the mail,' McClelland told party members without identifying himself during a Sept. 23 round of robocalls. 'Over the next few days, your district leader or representative will contact you personally to have you sign the official proxy. Thank you in advance for your cooperation and service to the Republican party.'...”

Nobody has mentioned yet that Judge Walker SAID he could find if the Golden side had a majority of the proxies, they would have voted to continue the convention outside the Remsen Hall and elect Ted Ghorra as the Republican County Chairman.

One of the attorneys involved in the case said that it sure looked like Justice Edgar Walker wanted nothing in the "court record" that would require his referral of the case to the Brooklyn DA, because of possible criminal activity. And anything indicating a quid pro quo between Golden and Rudiano for her continuing her job at the Brooklyn BOE would be evidence of a crime.
Or just possibly the fact that Rudiano became clerk when Hy Singer was Chairman and kept on by Craig Eaton shows a link between eaton and Rudiano that went sour.

ok. So we know Judge Walker wrote an outline for another one of his cases on appeal.

1- Who is going to buy the transcript?
2- Who is going to write the appeal?
3- Who is going to do all the copies for 9 briefs and get them bound?
Word on the street is Arnaldo has a good lawyer.
There's a much bigger story here. Why is the New York State Senate Republican Conference participating in the selection of the Kings County Republican leadership and paying for the Golden faction's legal fees?
ReplyDeleteThere has been a silent coup by Republican state senators putting the conference's interests and their personal interests ahead of those of the rest of the NYS GOP. That is high level corruption inside the NYS Republican Party and somebody needs to look into it and stop it.
The way that this case went down in front of Judge Edgar Walker shows how the corruption from AND AROUND Marty Golden infects even the NYS courts. Proof of some of that corrupting influence came out of Justice Edgar Walker's own mouth, when witness Diane Haslett-Rudiano testified the she "... knew [Golden's attorney John] Ciampoli very well..."; Judge Walker INTERRUPTED and said, "everybody knows John Ciampoli..." [Walker then cut-off any questioning that had been intended to show how much Ciampoli was involved in the Golden faction's pre-convention and convention activities -- cutting off any opportunity to call John Ciampoli as a witness].

I'm sure that one of the comments above related to the decisions in one or more of these cases: FEC v. NEW YORK STATE CONSERVATIVE PARTY STATE COMMITTEE/1984 VICTORY FUND (87-3309) and FEC v. 1984 Victory Fund (Civil Action Nos. 86-3891 and 85-8384). Those cases dealt with wrong-doing by the NYS Conservative Party on behalf of the U.S. Senate candidacy of Florence Sullivan in a GOP primary back in the 1980's.
In a digest of a consent order entered against the Conservative Party, "The consent order required the Victory Fund to amend its reports and pay a $15,000 civil penalty.... Finally, the defendants were permanently enjoined from future similar violations...." (See FEC Web Page/ Litigation Court Cases [http://www.fec.gov/law/litigation_CCA_FEC_N.shtml]). [Note: arguably what is involved is a "future similar violation" sufficient for coverage by the 1980's consent decree.]
Using the above as "predicate acts" --- given the ongoing nature of the Conservative Party as an "enterprise" --- and seeing the current joint practices of Marty Golden and the NYS Senate Republican Caucus, another "Enterprise", and of his employees James McClelland, who admitted making false and misleading telephone robo-calls, and another Golden employee and acolyte, Jerry Kassar, who has been and continues to be a high officer of the NYS Conservative Party from the time of the original consent decree to the present, and who allowed Golden to use Conservative Party assets in connection with and during the period of the 2015 Republican "Primaries" and convention --- U.S. Attorney Preet Bharara needs to look into all this stuff with an eye towards a pattern of R.I.C.O. violations.
That case Gail so casually referenced above was fall out from 1982 republican US Senate primary. Muriel Siebert lost GOP primary to Florence Sullivan. Siebert sued Conservative party over laws about party officials meddling in other party primaries. All sounds very un libertarian.

The case against Mike Long and conservative party was a federal court case that went against Long by trial court. Long got it reversed on appeal. The issue was could a candidate assert a lawsuit against another based on those wacky laws. Court of appeals said no. Only a political party can sue.
ReplyDeleteAll this shows that, both now and then, the Conservative Party interferes with the Republican Party, and they get overly involved in everything that Republicans try to do. This has been, and it continues to be, a bad thing for the Republicans and a good thing for the Democrats.
