"Republicans For Change" against Chairman Craig Eaton and the Brooklyn GOP — Very little storm in Court amid big winter storm outside

Against the backdrop of a major winter storm swirling around the Brooklyn Civic Center and the rest of the City  ---  The "parties" to "the big case" to set aside results the 2013 Brooklyn GOP County Convention were in Brooklyn Supreme Court to argue about the Defendant Chairman Eaton's and the Brooklyn GOP's motion to shovel the whole thing to the curb


Yesterday, Justice David Schmidt reserved judgment in the case with the abbreviated title, "Rudiano v. Eaton" (Kings Index No. 017848/2013), after the defendants' counsel had completed his legal arguments that the matter needed to be dismissed because all the necessary parties had not been joined in the action. According to the defendants, no relief could be granted by the Court in this election matter, because the plaintiffs had neither served nor named the New York State Board of Elections as a party in the case.

Perhaps surprisingly for some, the plaintiffs' attorney only made a perfunctory response to the defendants' motion for a partial summary judgment of dismissal; and there were no discussions as to the substantive merits of the plaintiffs' case.

Justice Schmidt indicated that he would render his decision on the motion for dismissal in due course and that he would contact the parties if he wanted any additional information or needed to see them for any reason concerning the case in the future.

  1. It is interesting that Marty Golden is the entire "brains" behind this case, even though it is quite obvious they did not think before filing this suit. Marty does not want his name to be party of a lawsuit since he will be soon running again, but Craig should do everything in his power to ensure the entire GOP party in Brooklyn knows about the details regarding this case - that Marty is a crook, he threatens his employees, he slanders good leaders all throughout NYC, takes his so called "friends" to court after not getting his way, etc. Marty has been getting away with his antics for far too long and someone has to put a stop to it. I am sure Timmy "Hotdog" Cochrane has a spot for him behind the counter at Windmill Hotdogs, or maybe Marty and Timmy can manage the place together? Great idea!!!

    1. So, let me get this straight....

      You don't like GOP State Senator Martin Golden. You think he is the prime mover behind the "Republicans for Change" and its proposed new "county leader" Timothy Cochrane; and that the lawsuit against Eaton and the rest of the Brooklyn GOP, with Diane Rudiano, Glenn Nocera, and the Daly sisters as the named plaintiffs, is in reality his brainchild. Oh, you also think that this is the way he has done his political business all along.

      Does that pretty much cover it ?

    1. "[T]he Daly Sisters" are Maureen Daly and Marie E. Daly, who are half of the named Plaintiff-Petitioners for the lawsuit against Chairman Craig Eaton and many in the Brooklyn GOP. Both of these women swore to countless items that are part and parcel of the lawsuit, for which they had no actual knowledge. Those factual allegations are contained in a supporting affidavit verified by both of the Dalys, even though neither was present at most of the events about which they provided sworn observations.

      Something else that is very interesting is that the signatures of Maureen Daly and Marie E. Daly, as they appear on the verification(s) to the supporting affidavit, seem to be written in an identical handwriting. This is only one of several instances where there seems to have been some question as to where the individual personae of this pair of sisters begin and end....

    2. Do these Dalys have a long involvement in Brooklyn GOP politics Gale? Where did they come from and how did they become so prominent as to appear as petitioners in the RFC lawsuit?

    4. No story about the political history of the Daly "sisters" is complete without hearing the "Hardhat Andy" Sullivan version of the sisters' saga....

    6. Of course, only Mr. Sullivan can authoritatively speak to that, but he does have some interesting things to say.... After all, Maureen D. was a key person in his campaign for City Council early in 2013.

You say that "the plaintiffs' attorney only made a perfunctory response to the defendants' motion for a partial summary judgment of dismissal; and there were no discussions as to the substantive merits of the plaintiffs' case", however it was the plaintiff who made a motion for partial summary judgment and the defendants who made a motion to dismiss.....who are you saying gave a perfunctory response and had no discussions of the substantive merits of which case - Eaton or the RFC?

    At the end of these cases both parties are usually unhappy

  7. Does anything that the nominal plaintiffs, Diane Rudiano, Glenn Nocera, and Maureen and Marie E. Daly have to say about things matter? Didn't the attorneys for both sides agree about the basic "facts" of the case?
